## 1. About These Terms

These Terms of Service govern your use of the $10 Minis website, your submission of 3D model files, and your purchase of resin 3D printing services and physical printed products from $10 Minis.

By accessing our website, uploading a file, submitting a quote request, placing an order or otherwise using our services, you agree to these Terms of Service.

If you do not agree to these Terms, do not use the website, upload a file or place an order.

These Terms operate alongside our:

- Returns & Refunds Policy
- Privacy Policy
- Shipping Policy
- File Requirements page
- Any written quote, order confirmation or product-specific terms provided by $10 Minis

If there is an inconsistency between these Terms and a written quote accepted by $10 Minis, the written quote applies to the extent of that inconsistency.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

## 2. Our Service

$10 Minis provides a made-to-order resin 3D printing service.

Customers upload or otherwise provide a compatible 3D model file and provide instructions about the required quantity, intended scale, target dimensions and any relevant print notes. We prepare the file for printing, produce a physical resin print, wash, cure, process and package the item, then dispatch it in accordance with the selected service and our published production schedule.

Unless explicitly stated otherwise, $10 Minis provides:

- A **physical, unpainted resin print**
- Basic file review for printability
- Resin printing
- Washing and curing
- Support removal and reasonable post-processing
- Protective packaging for shipping

Unless explicitly stated in writing, $10 Minis does **not** provide:

- 3D model design, sculpting or character creation services
- Digital STL files, model files or downloadable products
- Ownership of customer-supplied model files
- File repair, mesh repair, remodelling or engineering services beyond basic print preparation
- Painting, priming, assembly, basing or finishing services
- A guarantee that every supplied file can be printed at every requested scale
- Permission to use, reproduce, sell or distribute any customer-supplied model file

## 3. Eligibility

You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order with $10 Minis.

You must provide accurate and complete information when creating an order, uploading a file, requesting a quote or communicating with us.

You are responsible for maintaining the confidentiality of any account credentials associated with the website and for activity conducted through your account.

## 4. Customer-Supplied Files

### 4.1 Your Responsibility

You are responsible for ensuring that every file you upload or provide is:

- The correct file for your intended order
- Complete, accessible and compatible with our stated file requirements
- Submitted with accurate instructions about scale, dimensions, quantity, parts and print notes
- Free from malicious code, viruses or harmful content
- Supplied in a format we accept
- Suitable for resin 3D printing, subject to our review
- Lawful for us to receive, process and print

You are responsible for checking the file, intended size, quantity and instructions before placing an order.

### 4.2 File Review

We may review supplied files before printing. A review is intended to identify obvious printability, size, pricing, licensing or production issues. It is not a guarantee that a file is error-free, fit for a particular purpose or capable of being printed exactly as a digital preview may suggest.

We may contact you if we identify an issue, including where a model:

- Is larger or more complex than the selected service covers
- Requires a revised quote
- Is likely to fail or produce an unsatisfactory result
- Contains non-manifold geometry, missing surfaces, zero-thickness sections, unsupported floating geometry or corrupted mesh data
- Has walls, features or details that are too thin or fragile at the requested scale
- Is hollowed without appropriate drainage holes
- Requires multiple parts, special supports, orientation changes or different production settings
- Cannot reasonably be printed using our available equipment or materials
- Raises questions about ownership, licensing, safety or legality

We may recommend a different scale, orientation, part split, support arrangement, print approach or revised quotation. We will not proceed with a materially different approach without first contacting you, except where a minor adjustment is reasonably necessary to achieve the agreed result and does not materially change the requested item.

### 4.3 Refusal Or Cancellation

We may decline, pause, cancel or refund an unprinted order where:

- The supplied file is unsuitable for printing
- The file or instructions are incomplete or unclear
- The order is incorrectly priced due to size, complexity, quantity or technical requirements
- We reasonably believe that printing the file could infringe a third party’s rights
- We reasonably believe the file is unlawful, unsafe, offensive, harmful or inappropriate
- The customer does not respond to a reasonable request for clarification
- Production capacity, equipment failure, material availability or other circumstances outside our reasonable control prevent fulfilment

Where possible, we will contact you before cancellation and offer reasonable options, such as a revised quote, amended scale, replacement file or refund for services not yet performed.

## 5. Intellectual Property And Print Permissions

### 5.1 Customer Warranty

By uploading or providing a model file, you represent and warrant that:

- You own the file, or have the necessary licence, permission and authority to have $10 Minis print it
- The requested print does not infringe another person’s copyright, trade mark, design right, patent, privacy right, publicity right, contractual right or other legal right
- You have complied with the relevant creator, marketplace, subscription, commercial-use or personal-use licence terms
- You have permission to use a third-party printing service where required by the applicable licence
- You will not ask us to reproduce, distribute, sell or otherwise deal with a file in a way that is unlawful or unauthorised

You must not upload files where the licence permits only personal printing at home, or otherwise prohibits third-party production, unless you hold additional permission that allows $10 Minis to print the file.

### 5.2 No Transfer Of Ownership

You retain ownership of your customer-supplied file, subject to the rights you grant to us under these Terms.

You grant $10 Minis a limited, non-exclusive, non-transferable and revocable licence to store, review, prepare, print and use your file solely to fulfil your order, provide related customer support, manage quality issues, meet legal obligations and otherwise operate the service as described in these Terms and our Privacy Policy.

We do not claim ownership of your file. We will not sell, publish, distribute or make your file available to other customers without your express written permission.

### 5.3 Our Rights

$10 Minis retains all rights in:

- Our website, branding, photographs, copy, templates and processes
- Our original designs, if any
- Our print settings, support strategies, production methods and operational know-how
- Any improvements, templates or non-identifiable learnings developed independently of your file

You must not copy, reproduce, modify, distribute, scrape, reverse engineer or misuse our website content, branding or other intellectual property without our written permission.

### 5.4 Indemnity

To the extent permitted by law, you agree to indemnify and hold $10 Minis harmless from losses, claims, liabilities, damages, costs and expenses arising from a breach of your obligations under this section, including claims that a file you supplied infringes a third party’s intellectual-property rights.

This clause does not limit rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

## 6. Pricing, Quotes And Payment

### 6.1 Standard Price

Where advertised, the $10 starting price applies only to the specific standard resin-print service described on the relevant product page.

Unless otherwise stated, the standard price applies to one eligible standard tabletop miniature up to **32mm** in the stated measurement convention. It does not necessarily apply to larger, multi-part, high-volume, fragile, highly detailed, hollowed, complex or unusual models.

Shipping, taxes and any additional services are shown separately where applicable.

### 6.2 Quotes

Larger or non-standard models may require a custom quote.

Quotes may be based on factors including:

- Model dimensions
- Resin volume
- Print duration
- Number of pieces
- Support and post-processing requirements
- Model geometry and fragility
- Required quantity
- Packaging requirements
- Material choice
- Delivery requirements

Unless stated otherwise, a quote is valid for **14 days** from the date it is issued. We may revise a quote if the file, quantity, dimensions, specifications or production requirements change.

### 6.3 Payment

Payment must be made through the payment methods available at checkout or as otherwise agreed in writing.

For standard online orders, payment is generally required before production begins.

For custom quoted orders, we may require full payment or a deposit before commencing file preparation, production or ordering special materials. Any deposit requirements will be stated in the relevant quote or invoice.

### 6.4 Pricing Errors

We take reasonable care to ensure prices are accurate. If an obvious pricing, technical or listing error occurs, we may contact you to explain the issue, offer the correct price or cancel and refund the unfulfilled portion of the order.

## 7. Production, Dispatch And Delivery

### 7.1 Weekly Batch Schedule

$10 Minis operates a weekly batch-production model.

Orders received and confirmed before the published weekly cutoff are generally scheduled for weekend production and Monday dispatch. Orders received after the cutoff, or orders requiring clarification, file review, quote approval, revised specifications or additional customer information, may be allocated to a later batch.

Published production and dispatch dates are estimates unless expressly confirmed as guaranteed in writing.

### 7.2 Production Delays

We aim to meet the stated production schedule, but delays can occur due to:

- File review or clarification requirements
- Print failures or reprints
- Equipment maintenance or malfunction
- Resin or packaging supply issues
- Public holidays
- Extreme weather, power interruption or other events outside our reasonable control
- Carrier delays
- High order volumes

If a material delay occurs, we will take reasonable steps to notify affected customers.

### 7.3 Delivery

Orders are dispatched using the delivery method selected or offered at checkout.

Delivery estimates are provided by carriers and are not guaranteed by $10 Minis unless expressly stated otherwise. Delivery times can vary based on destination, carrier conditions, public holidays, weather events and other factors outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Additional postage or redirection costs may apply if an order is returned due to an incorrect, incomplete, undeliverable or uncollected address.

### 7.4 Risk And Title

Title in the physical printed item passes to you once we have received full payment.

Risk in the physical printed item passes in accordance with applicable law. Nothing in this clause limits rights you may have under the Australian Consumer Law in relation to goods damaged before delivery or otherwise not supplied in accordance with consumer guarantees.

## 8. Resin Print Characteristics And Customer Care

Resin 3D printing produces detailed physical models, but resin prints have characteristics that differ from injection-moulded plastic, metal casting and hand-sculpted products.

Minor support-contact marks, subtle layer lines, slight surface variations, separate parts, delicate fine features and limited cleanup requirements may be normal characteristics of a resin print and are not necessarily defects.

Physical resin prints may include thin or delicate components such as blades, horns, wings, fingers, tails, bows, antennae or narrow limbs. Handle items carefully during unpacking, assembly, painting and play.

Unless expressly agreed in writing, prints are supplied unpainted. You are responsible for suitable priming, assembly, painting, basing, storage, handling and use after delivery.

Do not use resin prints for food contact, medical use, children’s toys, safety-critical purposes, high-heat applications or any purpose for which they have not been specifically designed and approved.

## 9. Cancellations, Returns And Refunds

Our Returns & Refunds Policy forms part of these Terms.

Because orders are made to order from customer-supplied files, change-of-mind cancellations, refunds and exchanges may not be available once file preparation or production has commenced.

This does not affect your rights under the Australian Consumer Law.

If a product or service does not meet an applicable consumer guarantee, you may be entitled to a remedy, including repair, replacement, refund, cancellation or compensation, depending on the nature and seriousness of the problem.

To report a problem, contact us promptly at **[Insert customer support email]** and include your order number, a description of the issue and clear photographs where relevant.

Do not return an item without contacting us first, unless we have instructed you to do so.

## 10. Privacy And Customer Files

We handle personal information in accordance with our Privacy Policy.

By using our services, you acknowledge that we may collect, use and store information needed to process your order, communicate with you, deliver products, manage payments, provide customer support, comply with legal obligations and operate our website.

Customer-supplied model files are stored and processed only as reasonably necessary to review, prepare, fulfil and support your order, resolve quality issues and comply with legal obligations.

Unless you separately opt in to longer storage, we aim to delete customer-supplied model files within **30 days** after order completion, subject to reasonable backup, security, legal, dispute-resolution and record-keeping requirements.

You should keep your own copy of every file you submit. We do not guarantee indefinite retention, recovery or future availability of uploaded files.

## 11. Website Use

You must not use the website in a way that:

- Is unlawful, fraudulent, misleading or deceptive
- Interferes with the website’s security, availability or operation
- Attempts to access systems, accounts, data or features without authorisation
- Uploads viruses, malware or harmful code
- Uses automated tools to scrape, copy, index or extract website data without our written permission
- Infringes the rights of another person
- Harasses, abuses, threatens or harms $10 Minis, our suppliers, service providers or other users
- Circumvents payment, file-review, quote, licence-confirmation or order processes

We may suspend or restrict access to the website or refuse an order where we reasonably believe these Terms have been breached.

## 12. Disclaimers And Limitation Of Liability

To the maximum extent permitted by law:

- We do not guarantee that every uploaded file can be printed, will print successfully at the requested scale or will meet a particular subjective aesthetic preference.
- We are not responsible for problems caused by inaccurate customer instructions, unsuitable files, customer-supplied licensing issues, incorrect addresses, customer handling, assembly, painting, modification or misuse after delivery.
- We are not liable for indirect, special, incidental, consequential or economic loss, including loss of profit, loss of opportunity, loss of data, loss of goodwill or loss arising from a third-party licence dispute, except where liability cannot lawfully be excluded.
- Our total liability relating to an order is limited to the amount paid for the relevant order, except where Australian Consumer Law or another law requires otherwise.

Nothing in these Terms excludes, restricts or modifies consumer guarantees or other rights that cannot lawfully be excluded, including rights under the Australian Consumer Law.

## 13. Changes To These Terms

We may update these Terms from time to time to reflect changes to our services, processes, legal requirements or website features.

The version published on the website at the time you place an order generally applies to that order, unless a change is required by law or is clearly more favourable to you.

The “Last updated” date shows when these Terms were most recently revised.

## 14. Governing Law

These Terms are governed by the laws of Victoria, Australia.

You and $10 Minis submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them.

Nothing in this section prevents a consumer from relying on mandatory protections that apply under the laws of another Australian state or territory.
